Wage and Hour Updates
Join us for a free breakfast seminar on wage and hour updates that will impact virtually every employer in the United States. The U.S. Department of Labor is in the process of finalizing regulations that will significantly change the federal wage and hour overtime “white collar” exemptions for executive, administrative, professional, and highly compensated employees, which were last updated in 2004. Employees in these categories are not paid overtime if they perform certain duties and if they are paid a minimum salary, which is currently set at $455 per week or $23,660 per year. As it stands, the proposed regulations would more than double the current minimum salary to $970 per week or $50,440 per year starting sometime in 2016. The Department of Labor is also proposing an automatic annual update to this minimum salary level and, while less than clear, these new regulations may also change the “duties” test tied to these exemptions.
The Department of Labor estimates that 21 million employees are currently subject to this minimum salary level and may potentially be affected by the new rules. For those affected employers will be faced with increasing the minimum salary level or moving the employee to an overtime-eligible status. These changes will have a tremendous impact on rural states like Idaho.
In this seminar, we will provide an overview of the existing “white collar” regulations, a review of the proposed regulations, and ideas on best practices to prepare for these significant changes in 2016. We will also overview the Department of Labor’s recently revised administrative interpretation on proper classification of employees (vs. independent contractors). Idaho’s Department of Labor wage and hour division is vigorously auditing Idaho employers on this new interpretation and citing employers for improperly classified independent contractors (who should be classified and paid as employees).
Our guest speaker for this seminar is Kara Heikkila, an employment attorney who works in the Coeur d’Alene and Boise offices for Hawley Troxell, Idaho’s largest full service business law firm. Kara, a native of North Idaho, has over 25 years of collective work advising employers on personnel and human resource matters.
